These Terms and Conditions may be changed by us from time to time without notice to you. YOUR CONTINUED USE OF THE WEBSITE AFTER THE POSTING OF ANY REVISIONS SHALL BE CONSIDERED YOUR AGREEMENT TO THE UPDATED TERMS. However, if you place an order through the Website or use any Hi Five Club services, the Terms and Conditions applicable to that order will be those in force on the date you place your order.

Donations

These Terms and Conditions, as amended from time to time, govern the relationship between you and WHiYOU Ltd, company number 15225246, trading as Hi Five Club, concerning the donation contributions we make to selected charities, foundations, Community Interest Companies and other eligible community organisations through our Website at https://www.hi-five-club.com.

 

By using the Website and purchasing our products or services, you acknowledge that a donation contribution is incorporated into eligible purchases under our 10% donation pledge. You also agree to be bound by these Terms and Conditions and our related policies.

Hi Five Club is the public-facing trading brand of WHiYOU Ltd.

1. Our Agreement with You

​

A donation contribution of at least 10% of the gross profit from every product and service sale is automatically included as part of the Hi Five Club pledge. This contribution cannot be removed or opted out of by the customer.

We retain discretion over the administration of the pledge, including the organisations and causes that receive support. The percentage contributed may increase above 10% for particular products, services, campaigns or partnerships. However, it will not fall below 10% of gross profit.

We may change the selected beneficiary where reasonably necessary, while continuing to direct the contribution towards one or more of our stated Hi Five Pledges.

​

The agreement between you and us will be entered into once we have accepted your purchase of a Hi Five Club product or service.

2. The Donation

​

We will administer our pledged contributions in line with the stated aims of the Hi Five Club and our Hi Five Pledges, supporting selected charities, social enterprises and community organisations.

​

2.1 Donation Percentage: Hi Five Club pledges to contribute a minimum of 10% of the gross profit from all product and service sales to selected charities, social enterprises or community support partners. We may increase the donation percentage for individual products, services, campaigns or partnerships at our discretion.

2.2 Donation Transparency: Information about the funds donated through the Hi Five Club will be displayed on the Website and updated periodically.

By purchasing a Hi Five Club product or service, you acknowledge and accept that the applicable donation contribution forms part of our commitment and is managed by WHiYOU Ltd trading as Hi Five Club.

3. Refunds

​

Where a return and refund has been approved, we will provide the applicable refund or product exchange in accordance with our Refunds, Returns and Shipping Policy and your statutory rights.

Any donation contribution connected with a refunded purchase will remain the responsibility of WHiYOU Ltd. Customers will not be required to repay or separately cover that contribution.

3.1 Protecting the Company: We reserve the right to investigate orders or refund requests where we reasonably suspect fraud, misuse or an attempt to exploit the donation system. This may include unusually large or repeated orders that appear to have been placed to trigger excessive donation contributions before being cancelled or returned.

3.2 Refund Investigations: Where we reasonably suspect that a bulk order or refund request is fraudulent or abusive, we may delay processing the request while we investigate the circumstances. Nothing in these Terms and Conditions limits or removes your statutory consumer rights.

4. General

​

This agreement is between you and WHiYOU Ltd trading as Hi Five Club. No other person shall have any right to enforce any of its terms.

Limitation of Liability: To the fullest extent permitted by law, WHiYOU Ltd shall not be liable for indirect or consequential loss arising from or related to your voluntary participation in Hi Five Club activities.

 

Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited.

If we do not immediately insist that you fulfil an obligation under these Terms and Conditions, or if we delay taking action in relation to a breach of this agreement, this will not release you from that obligation or prevent us from taking action at a later date.

These Terms and Conditions are governed by English law. If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in Scotland. If you live in Northern Ireland, you may also bring proceedings in Northern Ireland.
